Scope and Purpose of the General Terms and Conditions

These General Terms and Conditions are intended to govern the terms and conditions under which the Services are provided by Equanto - Intercâmbio comercial e industrial S.A., with its registered office at Zona Industrial das Corredouras Lt 8, 2630-369 Arruda dos Vinhos. The Service consists of providing information relating to a range of products and/or services and enables the User to order the products advertised therein electronically, in accordance with the terms and conditions set out herein.
Orders for products must be placed by Users aged 18 (eighteen) years or over (individuals under this age must have the authorisation of their legal guardians). The details and information provided by the User shall have full legal effect, and the User acknowledges the electronic purchases; the User may not claim the absence of a signature as grounds for non-compliance with the obligations undertaken.

Equanto - Intercâmbio comercial e industrial S.A. accepts no liability for delays or failures to meet deadlines where such delays or failures result from events or circumstances beyond the control of the website’s administration. Should any product be unavailable after you have placed your order, you will be notified by email. At that point, you will be given the option to cancel the order and receive a refund, should you have already made the payment. All information regarding prices, products, specifications, promotional offers and services may be changed at any time by Equanto - Intercâmbio comercial e industrial S.A.

Responsibilities

3.1 All products and services sold via the Equanto - Intercâmbio comercial e industrial S.A. Online Store comply with Portuguese law.

3.2 If, for any reason relating to an error in accessing the Equanto - Intercâmbio comercial e industrial S.A. Online Store website, it is impossible to provide the service, Equanto - Intercâmbio comercial e industrial S.A. shall not be liable for any losses.

3.5 Equanto - Intercâmbio Comercial e Industrial S.A. shall not be liable for any loss or damage arising from the non-performance or defective performance of the Service where such loss or damage is not directly or indirectly attributable to it by way of wilful misconduct or gross negligence, and shall not be liable in particular for (i) errors, omissions or other inaccuracies relating to the information made available through the Service; (ii) damage caused by the fault of the User or third parties, including infringements of intellectual property rights; (iii) non-performance or defective performance resulting from compliance with court orders or decisions by administrative authorities; or (iv) non-performance or defective performance resulting from the occurrence of force majeure events, i.e. situations of an extraordinary or unforeseeable nature, beyond the control of Equanto - Intercâmbio comercial e industrial S.A., and which cannot be controlled by it, such as fires, power cuts, explosions, wars, riots, civil unrest, government decisions, strikes, earthquakes, floods or other natural disasters, or other situations beyond the control of Equanto - Intercâmbio comercial e industrial S.A., which prevent or hinder the fulfilment of the obligations undertaken.

Consumer Obligations

4.1. The user undertakes to provide accurate personal details and addresses, not to use false identities, and to comply with the order limits imposed.

4.2. Should any of the details be incorrect or insufficient, and should this result in a delay or inability to process the order, or failure to deliver, the User shall be liable, and Equanto - Intercâmbio comercial e industrial S.A. accepts no liability. Should the consumer breach any of these obligations, Equanto - Intercâmbio comercial e industrial S.A. reserves the right to prevent future purchases, block access to the shop, and cancel the provision of any other services simultaneously offered by Equanto - Intercâmbio comercial e industrial S.A. to the same User; and, furthermore, to deny the User future access to any and all services provided by Equanto - Intercâmbio comercial e industrial S.A.

4.3. The use of purchased products and services for commercial purposes, specifically for the resale of goods, is expressly prohibited.

Order Cancellation

5.1 At the User’s Request
The User may cancel their order by email, requesting this from Equanto - Intercâmbio comercial e industrial S.A., provided that the cancellation is made within two hours of the order being confirmed.
To cancel an order, the User must provide the order number.

Warranty

All products available in the Shop are duly certified by the relevant national and international authorities.

Intellectual Property

All content on this website is the exclusive property of Equanto - Intercâmbio comercial e industrial S.A., including text, images, or any other type of information not originating from third parties. As such, they are protected by the Copyright Act. Equanto - Intercâmbio comercial e industrial S.A. reserves the right to make changes to this content at any time, without any obligation to give prior notice to users.

Service Security Conditions

8.1. The User undertakes to comply with all applicable legal provisions, in particular to refrain from engaging in or encouraging acts that are unlawful or contrary to public decency, such as the indiscriminate sending of unsolicited communications (spamming) in breach of the provisions of the legislation applicable to the processing of personal data and to advertising communications via automatic calling devices, and must also comply with the rules of use of the Service, failing which Equanto - Intercâmbio comercial e industrial S.A. may suspend or deactivate the Service.

8.2. The User expressly acknowledges and accepts that the IP Network constitutes a public electronic communications network capable of being used by multiple users, and as such, is subject to network congestion; consequently, Equanto - Intercâmbio comercial e industrial S.A. does not guarantee the provision of the Service without interruptions, loss of information or delays.

8.3. Equanto - Intercâmbio comercial e industrial S.A. also does not guarantee the provision of the Service in situations of unforeseeable system overload or force majeure (situations of an extraordinary or unforeseeable nature, external to Equanto - Intercâmbio comercial e industrial S.A., and which cannot be controlled by it).

8.4. In the event of an interruption to the provision of the Service due to an unforeseeable overload of the systems on which it operates, Equanto - Intercâmbio comercial e industrial S.A. undertakes to restore normal service as soon as possible.

Suspension and termination of the Store Service

Regardless of any prior or subsequent notice, Equanto - Intercâmbio comercial e industrial S.A. may, at any time and at its sole discretion, discontinue the provision of the Service or any part thereof to one or all Users.

Communications

10.1. Without prejudice to other forms of communication provided for in these General Terms and Conditions, notifications sent to the User relating to the Service, including any amendments to these General Terms and Conditions, may be sent to the User’s email address, by SMS or by telephone.

10.2. The User agrees to receive any and all communications and/or notifications relating to the Online Store at the address, contact telephone number and/or email address (“email”) provided during the ordering process.

At any time, you may request to opt out of receiving these communications and/or notifications via the Contact Form.
